Terms of Service

1. Acceptance of Terms

By creating an account or using CardZen ("the Service"), operated by CardZen ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use CardZen. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Subscription & Billing

Plans

CardZen offers a free tier and paid subscription plans. Features and usage limits vary by plan as described on our Pricing page.

Payment

  • Paid subscriptions are billed monthly through Stripe.
  • Your subscription automatically renews each billing cycle unless you cancel before the renewal date.
  • Prices are subject to change with 30 days' notice.

Refunds

We do not offer refunds for partial subscription periods. If you cancel, you will retain access to paid features until the end of your current billing cycle. If you experience a technical issue that prevents you from using the Service, contact support@cardzen.io and we will review your case.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Scrape, crawl, or otherwise automatically extract data from the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious content or files
  • Use the Service to manipulate or misrepresent card values or transactions
  • Create multiple free accounts to circumvent usage limits
  • Resell or redistribute access to the Service

6. Your Content & Data

Ownership

You retain all rights to the data you upload to CardZen, including card images, collection data, and transaction records. We do not claim ownership of your content.

License

By uploading content to CardZen, you grant us a limited license to process, store, and display your content solely for the purpose of providing the Service to you. This includes sending card images to AI providers for identification.

Data Portability

You may export your data at any time using the export features available in the Service, subject to your subscription plan.

7. AI-Generated Data Disclaimer

CardZen uses artificial intelligence (AI) to identify cards from photographs. While we strive for accuracy, AI-generated results are provided on a best-effort basis and are not guaranteed to be correct. You are responsible for reviewing and verifying all AI-identified card information before relying on it for purchasing, selling, grading, or valuation decisions.

We are not liable for any financial loss resulting from incorrect AI identification, including but not limited to: wrong card identification, incorrect grade estimation, or inaccurate pricing information.

8. Third-Party Services

CardZen integrates with third-party services including:

  • eBay: When you connect your eBay account, you authorize CardZen to access your eBay data as described in our eBay Integration Privacy Policy. Your use of eBay through CardZen is also subject to eBay's own terms of service.
  • Stripe: Payment processing is handled by Stripe, subject to Stripe's terms of service and privacy policy.
  • Google Gemini / OpenAI: Card images are processed by AI services for identification. Images are processed in real-time and not retained by these providers beyond the processing request.

We are not responsible for the practices or availability of third-party services.

9. Intellectual Property

The CardZen application, including its design, code, features, and branding, is the intellectual property of CardZen. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, CardZen and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Financial decisions made based on AI-generated card identification
  • Errors in cost tracking, profit calculations, or pricing recommendations
  • Issues with third-party services (eBay, Stripe, AI providers)
  • Service interruptions or data loss

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Termination

  • By you: You may cancel your subscription and delete your account at any time through your account settings or by contacting support.
  • By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice.
  • Effect: Upon termination, your right to use the Service ceases. We will retain your data for 30 days after account deletion to allow for recovery, after which it will be permanently deleted.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or via email at least 30 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
